1. General
These Terms of Service (“Terms”) govern your use of the MediaStream plugin (“Plugin”), developed and distributed by BLURR SRL, a company registered in Italy (“we”, “us”, “our”).
By purchasing, installing, or using the Plugin, you agree to be bound by these Terms. If you do not agree, do not use the Plugin.
2. Definitions
“Plugin” refers to the MediaStream WordPress plugin, including all updates, patches, and documentation provided by BLURR SRL.
“License” refers to the right to install and use the Plugin on WordPress websites, subject to the plan purchased.
“Paddle” refers to Paddle.com Market Limited, the Merchant of Record that processes all payments on our behalf.
“BunnyStream” refers to the third-party video hosting and CDN service provided by Bunny.net (BunnyWay d.o.o.), which is required for the Plugin to function.
“You” / “Customer” refers to the individual or entity that purchases or uses the Plugin.
3. License grant
Upon purchase, we grant you a non-exclusive, non-transferable, revocable license to install and use the Plugin in accordance with the plan you have selected:
- Free plan: use on one (1) WordPress site with limited features, at no cost.
- Personal plan (annual): use on one (1) WordPress site per license, with access to all features.
- Business plan (annual): use on three (3) WordPress site per license, with access to all features.
- Agency plan(annual): use on unlimited WordPress site per license, with access to all features.
4. Restrictions
You may not:
- Redistribute, resell, sublicense, or share the Plugin or your license key with any third party.
- Modify, reverse-engineer, decompile, or create derivative works based on the Plugin, except as permitted under applicable open-source licenses for specific components.
- Remove or alter any proprietary notices, labels, or branding from the Plugin.
- Use the Plugin for any unlawful purpose or in violation of any applicable law or regulation.
- Share, publish, or expose your license key publicly.
5. Payments and billing
All payments are processed by Paddle, acting as the Merchant of Record. When you purchase the Plugin, you are entering into a transaction with Paddle, which handles billing, invoicing, VAT/sales tax, and payment processing on our behalf.
By completing a purchase, you also agree to Paddle’s Terms of Use and Privacy Policy, available at paddle.com.
Prices are displayed inclusive or exclusive of tax depending on your location. Paddle will apply the appropriate tax rate at checkout.
6. Subscription and renewal
Pro monthly plans renew automatically each month. Pro annual plans renew automatically each year. You may cancel your subscription at any time from your account dashboard or by contacting us.
Upon cancellation:
- Your Pro features remain active until the end of the current billing period.
- After the billing period ends, your account reverts to the Free plan.
- Your videos remain on BunnyStream and are not affected by cancellation.
7. Refund policy
We offer a 14-day, no-questions-asked refund policy. If you are not satisfied with the Plugin for any reason, you may request a full refund within 14 days of your initial purchase.
To request a refund, contact us at [email protected] or through your Paddle receipt. Refunds are processed by Paddle and typically appear within 5–10 business days.
Refunds are not available after the 14-day period, for renewal charges, or if we determine that the refund policy is being abused.
8. Third-party services
The Plugin requires an active BunnyStream account (provided by Bunny.net / BunnyWay d.o.o.) to function. We are not affiliated with, endorsed by, or responsible for the services, availability, pricing, or policies of Bunny.net.
You are solely responsible for:
- Maintaining your BunnyStream account and paying any associated fees directly to Bunny.net.
- Complying with Bunny.net’s Terms of Service and Acceptable Use Policy.
- Any content you host, stream, or distribute through BunnyStream.
We do not store, process, or have access to your video files. All video hosting, transcoding, and delivery is handled by BunnyStream.
9. Intellectual property
The Plugin, including its code, design, documentation, and branding, is the intellectual property of BLURR SRL and is protected by applicable copyright and intellectual property laws.
Your purchase grants you a license to use the Plugin. It does not transfer ownership of any intellectual property rights.
10. Support and updates
Pro plan subscribers receive access to priority email support and all Plugin updates for the duration of their active subscription.
Free plan users receive access to community-level support and major updates only.
We reserve the right to modify the scope of support and updates at any time, with reasonable notice.
11. Disclaimer of warranties
The Plugin is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Plugin will be error-free, uninterrupted, or compatible with all WordPress configurations, themes, or plugins.
- The Plugin will meet your specific requirements.
- BunnyStream or any third-party service will remain available or unchanged.
12. Limitation of liability
To the maximum extent permitted by applicable law, BLURR SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Plugin.
Our total liability under these Terms shall not exceed the amount you have paid to us for the Plugin in the 12 months preceding the claim.
13. Privacy and data
We collect and process personal data in accordance with our Privacy Policy, available at wpmediastream.com/privacy.
Payment data is handled exclusively by Paddle. We do not store credit card numbers, bank details, or other payment credentials.
The Plugin itself does not collect, transmit, or store any personal data from your website visitors. Analytics data, if any, is processed by BunnyStream under their own privacy policy.
14. Termination
We reserve the right to terminate or suspend your license if:
- You breach any provision of these Terms.
- You engage in fraudulent activity, license key abuse, or unauthorized redistribution.
- Required to do so by law or regulation.
Upon termination, you must immediately uninstall the Plugin and destroy all copies in your possession. Termination does not entitle you to a refund unless otherwise required by applicable law.
15. Changes to these terms
We may update these Terms from time to time. The updated version will be posted at wpmediastream.com/terms with the revised “Last updated” date.
Continued use of the Plugin after changes are posted constitutes your acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify you via email or through the Plugin’s admin interface.
16. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of the Italian Republic, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Italy.
If you are a consumer based in the European Union, you retain any mandatory consumer protection rights granted by the laws of your country of residence.
